Bolsonaro may be arrested if he fails to comply with isolation

President Jair Bolsonaro (no party) could face up to 1 year in prison if he fails to comply with a 14-day quarantine after arriving in Brazil this Wednesday morning (22), after traveling to the United States to participate in the United Nations General Assembly .

The imposition of social isolation upon arrival in Brazil to all members of the delegation was announced by the National Health Surveillance Agency (Anvisa) after the Health Minister, Marcelo Queiroga, was diagnosed with covid-19, while still on US soil.

In a statement, Anvisa sent a letter during the night to the Civil House of the Presidency of the Republic, giving health guidelines that follow the protective measures established to control the new coronavirus pandemic. The document points out that Bolsonaro must also follow them.

  • disembark in Brazil in order to expose as little environment and people as possible;
  • isolation 14 days after the last day of contact with the confirmed case of covid-19, as per the Epidemiological Surveillance Guide for covid-19 published by the Ministry of Health;
  • compliance with isolation in the city of arrival in Brazil, preventing further displacements until they have passed the period of transmission of the virus;
  • redo the covid-10 tests in Brazil.

Law 13979/20, which aims to protect the community and provides for the measures that may be taken by the government, in the face of an emergency situation in public health, establishes that people who do not accept to submit will be held liable under the terms existing legislation.

The Penal Code, in its article 268, provides for the crime of infraction of preventive sanitary measure, which punishes the conduct of violating a determination of the public authority, which has the purpose of preventing the entry or spread of a contagious disease.

Thus, whoever refuses to comply with the measures taken against the coronavirus may incur this illicit act, and may be sentenced to a penalty of 1 month to 1 year of imprisonment in addition to a fine.

Since the beginning of his trip to the United States, last Sunday (19), Bolsonaro and his companions have been the target of frequent protests, largely due to the president’s insistence not to be vaccinated against the new coronavirus and to indicate treatments that have already been proven to be ineffective for the disease.

Last Monday, Queiroga lost patience when the vehicle he was occupying faced a protest against the Brazilian entourage in New York. He got up from his stool, leaning his face close to the person sitting next to him to make obscene gestures through the window against the protesters.

This Tuesday, Bolsonaro spoke at the opening of the UN General Assembly, where he again defended ineffective treatments against covid.

In a meeting with the Prime Minister of the United Kingdom, Boris Johnson, the Brazilian repeated that he had not yet been vaccinated. For not having the immunization, the president was banned from entering restaurants in New York, and had pizza dinner on the sidewalk last Sunday.
