The president of the Federal Supreme Court (STF), Luiz Fux, canceled a meeting that would take place between the heads of powers after President Jair Bolsonaro (no party) insisted on attacking members of the Court and the electoral system.
The retired captain even said that he will not accept the result of the 2022 presidential election if the printed vote is not implemented.
The cancellation announcement also comes after Bolsonaro said he could act outside the Constitution, in reaction to the decision of Minister Alexandre de Moraes, also of the Supreme Court, to include the president’s name in the Fake News Inquiry, which investigates the dissemination of false news.
In reaction, Bolsonaro said that “the time” for Alexandre de Moraes “will come”.
“Mr. Alexandre de Moraes accuses everyone of everything, puts him as a defendant in his investigation. Investigation without any legal basis for intimidating operations, search and seizure, threat of arrest or even imprisonment. That’s what he’s been doing. His time will come because he has been playing outside the 4 lines of the Constitution for a long time”, declared the president in an interview with Radio 93 FM, from Rio de Janeiro.
He also said that he does not intend “to leave the 4 lines to question these authorities”. However, he believes that “this moment is coming.
We cannot continue with an arbitrary, dictatorial minister, who does not respect democracy, who has not read the Constitution, or has read it according to his understanding, in order to increasingly attack not only democracy but also achieve its goals. that way”, he concluded.
In his speech, Fux said that he even warned Bolsonaro about what he called “limits to the exercise of the right to freedom of expression, as well as the necessary and non-negotiable respect between the powers for institutional harmony in the country.” At another time, the minister still states that “efficient dialogue presupposes a permanent commitment to one’s own words, which, unfortunately, we have not seen in the current scenario.”
Check out Fux’s statement in full:
As President of the Federal Supreme Court, I alerted the President of the Republic, at a meeting held in this Court, during the July collective vacation, about the limits on the exercise of the right to freedom of expression, as well as the necessary and non-negotiable respect between the powers to the institutional harmony of the country.
However, as the Brazilian press has reported in recent days, the President of the Republic has reiterated offenses and attacks of untruths against members of this Court, especially Ministers Luís Roberto Barroso and Alexandre de Moraes.
In addition, His Excellency maintains the disclosure of mistaken interpretations of the Plenary’s decisions, as well as insists on putting under suspicion the healthiness of the Brazilian electoral process.
In light of these circumstances, the Federal Supreme Court informs that the meeting previously announced between the Heads of Power, including the President of the Republic, has been cancelled. The presupposition of the dialogue between the Powers is the mutual respect between the institutions and their members.
As I stated in a statement on the occasion of the opening of jurisdictional activities this semester, efficient dialogue presupposes a permanent commitment to one’s own words, which, unfortunately, we have not seen in the current scenario.
The Federal Supreme Court, in a cohesive manner, follows alongside the Brazilian population in defense of the Democratic State of Law and republican institutions, and will remain firm in its mission to judge with independence and impartiality, always observing the laws and the Constitution.
