MPF sues the Union for damages caused by the Car Wash and

Attorneys of the Republic Emanuel Ferreira and Camões Boaventura, of the Federal Public Ministry (MPF) in Rio Grande do Norte, filed last Monday (30) a public civil action against the Union for damages caused by the Lava Jato operation. The lawsuit is in the Federal Court in Mossoró (RN), and asks for recognition of the setbacks and damage caused by the task force and former judge Sergio Moro.

According to the MPF, Moro systematically violated “the necessary separation between the functions of judging and investigating”, in addition to offenses against the democratic regime as a whole.

“The magistrate acted in a partial and inquisitive way, showing interest in improperly influencing the 2018 presidential elections, after which he was appointed Minister of Justice [por Bolsonaro]”, says the initial petition of the action.

Moro led the trials that resulted in the convictions of former president Lula (PT) in the scope of Lava Jato in Curitiba (PR), overturned by the Federal Supreme Court (STF) for incompetence and partiality.

During the 2018 election, the former judge of Curitiba released a complaint by former minister Antonio Palocci against Lula, with no evidence, just to weaken Fernando Haddad’s (PT) candidacy, according to the Supreme’s interpretation.

Ferreira and Boaventura also claim that Lava Jato “unconstitutionally influenced the impeachment [de Dilma Rousseff] in 2016.”

In the action, the prosecutors ask the Union to promote “civic education for democracy” within the scope of the National School for Training and Improvement of Magistrates (Enfan) and the National School of Public Ministry (ESMPU), to prevent constitutional setbacks such as those of Lava Jet.

The authors ask that, in these courses, topics such as “militant democracy, constitutional and democratic erosion and new forms of fascist and populist authoritarianism are discussed, in order to qualify the respective professionals in the new tasks to be performed in favor of the regime’s protection democratic and in respect of the accusatory system.”
