In a virtual meeting this Thursday afternoon (2), the police ombudsman of São Paulo, Elizeu Soares Lopes, warned that military police officers who participate in the demonstrations on September 7 could be arrested.
In an interview with Brazil in fact, Lopes confirmed the alert.
SONORA ELISEU “Who said that is the law. This was said by the STF minister, (Ricardo) Lewandoviski. Any police officer who participates in demonstrations against the rule of law can be arrested. This is what the law, the Constitution and the Military Code say”, explained the ombudsman, quoting the article published by the minister of the Federal Supreme Court (STF) in the newspaper Newspaper, last Sunday (29).
“Here it should be noted that the eventual summons of the Armed Forces and auxiliary troops, based on article 142 of the Major Law, for the ‘defence of law and order’, when performed outside the legal hypotheses, whose configuration, in fact, it can be appreciated at a later time by Organs competent bodies”, argues Lewandovski.
“By the way, the Military Penal Code establishes, in article 38, paragraph 2, that ‘if the superior’s order has as its object the practice of a manifestly criminal act, or there is excess in the acts or in the form of execution, the inferior is also punishable ‘”, concludes the minister.
In addition to Lopes, representatives of the São Paulo Brazilian Bar Association (OAB-SP), the Public Defender’s Office and popular movements that organized the events of September 7 participated in the meeting.
Dimitri Sales, president of the São Paulo State Council for the Defense of Human Rights (Condepe-SP), said he was worried, but optimistic about the actions.
“That people are able to express their desire for democracy in a safe way and that they leave all preserved in their physical and moral integrity. And that Bolsonaro come out even more weakened”, concluded Sales.
