This Tuesday (3), the mayor of Rio de Janeiro, Eduardo Paes (PSD), presented the draft of the Master Plan for Sustainable Urban Development. The law deals with the urban development of the city and intends to create the Super Centro, from the densification of the Centro and Zona Norte and the Zona Franca Urbanística (ZFU) on Avenida Brasil. The proposal will still be sent to the City Council to be voted on.
The draft of the new Master Plan brings advances in relation to the 2011 law. The text incorporates the Land Use and Occupation Law (LUOS) and the Land Parceling Law (LPS). The revision also brings the regulation of Compulsory Parceling, Building or Use (PEUC), to guarantee the social function of the property, in addition to urbanistic instruments foreseen in the Cities Statute, such as progressive IPTU and Onerous Grant of the Right to Build.
“The current model of urban legislation in Rio is based on a great fragmentation of the legal framework, which, in order to work, would have to produce more than 40 laws, including the Master Plan, the Land Use and Occupation Law and Urban Structuring Plans for neighborhoods . Since the 70s, the city has been unable to update its legislation. This is a patchwork that doesn’t work” assessed the municipal secretary of Urban Planning, Washington Fajardo.
The new Master Plan also brings a commitment to social interest housing, in order to meet the large housing deficit in the city, which produces irregular occupations, land and property invasions and the uncontrolled growth of urban land, beyond inspection. The proposal is to produce a legal set that enables rapid licensing, residential densification in areas with infrastructure, incentives for social leasing, urban consortia, housing cooperatives, technical assistance and housing improvement programs.

Another novelty is the creation of the so-called Zona Franca Urbanística (ZFU) on Avenida Brasil, which comprises land in a 500-meter strip on each side of the road axis, in the stretch that crosses Planning Areas 1 and 3, where the urban parameters they would be analyzed on a case-by-case basis. The objective is, as this region has not changed in the last 30 years, to give freedom to residential and commercial real estate solutions.
In addition to discussions held by the city, the City Council has also debated updating the Master Plan since the beginning of 2021, with the creation of a special commission. The group, which held 14 meetings, seven of which were public hearings, discussed the city’s demands in a regionalized manner, by Planning Area of the city.
Mayor, Councilor Carlo Caiado (DEM) affirms that this is one of the main projects of the municipal Legislature, and highlighted the importance of the discussion having already started.
“This is a fundamental project for the city, which deals with everything that affects the population’s lives, in various aspects. Having started this debate early was fundamental so that we can now focus on the plan with a mature discussion, thinking about how we are going to create the bases for the city’s development in the next decade”, said Caiado.

On the 9th, the ninth public hearing will be held, before sending the final text to the Chamber.
