Roberto Jefferson Denied House Arrest Request

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), denied the request for replacement of preventive detention by domicile made by former deputy Roberto Jefferson, current president of the PTB. The politician claimed to be debilitated due to a serious illness and to have comorbidities that could be fatal, given the unhealthy prison system and the context of the covid-19 pandemic.

But, according to the minister, the restriction of the former deputy’s freedom remains unchanged and, therefore, it is impossible, at this procedural moment, to convert the prison.

The decision also takes into account the continued practice of criminal acts: last Sunday (29), Jefferson released a letter in which he continues to attack the STF and directly stated that “he will not accept to serve under house arrest with an ankle bracelet”, if eventually be granted. “Furthermore, it again incited the population against the STF”, the minister pointed out in his decision.

According to the rapporteur, there is no conclusive evidence of Jefferson’s health condition, who, until the date of his arrest, fully exercised the presidency of the Brazilian Labor Party (PTB). The intense political activity, without respecting social isolation and even with several visits to offices in Brasília (DF), far from his residence, in the interior of Rio de Janeiro, demonstrates, to the minister, the physical aptitude for long trips distance.

Another point observed by Minister Alexandre de Moraes is that Jefferson repeatedly posted on his social networks videos attacking the Powers of the Republic and the Democratic Rule of Law, on many occasions carrying firearms, practicing target practice and teaching people to attack agents public.
