Minister Luís Roberto Barroso, of the Federal Supreme Court (STF), denied a request for habeas corpus filed by the defense of federal deputy Daniel Silveira (PSL-RJ) and, with that, kept the congressman imprisoned in Niterói (RJ). The decision dates from the last 3rd, but it only came to light this Thursday (9).
The Pocketnarista was arrested again at the end of June for having violated the rules on the use of the electronic faucet about 30 times. He had switched to using the equipment in March, when he was allowed to serve under house arrest.

To request habeas corpus, the deputy’s defense asked for the invalidation of the decision that put him back in jail, claiming that the minister who issued it, Alexandre de Moraes, would not have analyzed the requests for revocation of preventive custody that had been filed.
Minister Barroso, however, argued that these requests only reproduced, “without any innovation in fact and/or in law, the same foundations underlying the previous postulation”.
Silveira was initially arrested in February, by order of Minister Alexandre de Moraes and after a request from the Attorney General’s Office (PGR), for attacking Court magistrates and inciting crimes through videos posted on the internet.
The congressman is one of the targets of the inquiry that investigates the undemocratic acts promoted by followers of President Jair Bolsonaro (no party). The process is proceeding under judicial secrecy.
